Prompt and Effective Investigations: Best Practices for Responding to Harassment Complaints

Conducting a thorough and effective workplace investigation is critical for effectively addressing harassment complaints in the workplace. By using practical, hands-on case examples, this session explores best practices to ensure that the investigation is adequately sufficient to “arrive at a reasonably fair estimate of truth,” as set forth in EEOC’s new Enforcement Guidance on Workplace Harassment. Specific discussion includes what constitutes a complaint and how to determine the proper scope of the investigation, maintain confidentiality, analyze evidence, assess credibility, and utilize various interviewing techniques.
